1. Definitions
- "Kaliber" / "we" / "us" / "our" — Kaliber, operating from 27 Jalan Sultan Ismail, 50250 Kuala Lumpur, Malaysia.
- "Client" / "you" — the individual or entity engaging Kaliber for watch servicing, restoration or collection care services.
- "Service" — any of the watch servicing tiers offered by Kaliber, including Full Mechanical Service, Vintage Restoration Programme and Collection Care Retainer.
- "Scope Document" — the written agreement issued to the Client before work commences, detailing the work to be performed and the agreed price.
- "Watch" — any timepiece submitted by the Client to Kaliber for service, assessment or restoration.
- "Agreement" — these Terms & Conditions together with any Scope Document issued for a specific service engagement.
2. Acceptance of Terms
By submitting a watch for service, signing a Scope Document, or engaging Kaliber through the website contact form or telephone, you agree to these Terms & Conditions. You confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under Malaysian law.
If you are submitting a watch on behalf of another person (e.g., as a gift or under an estate), you confirm that you have the authority to do so and that the terms will bind both you and that person.
3. Service Description
Kaliber offers three service tiers for privately owned mechanical wristwatches:
- Full Mechanical Service (RM 520) — complete strip-down, cleaning, lubrication, regulation and pressure test. Six to eight working day turnaround. Twelve-month workmanship cover on labour.
- Vintage Restoration Programme (from RM 2,850) — staged programme for watches from the 1940s onward. Scope agreed in writing before work begins. Typical duration four to eight weeks depending on parts availability.
- Collection Care Retainer (RM 4,400/year) — annual programme covering up to six watches. Includes scheduled timing checks, water-resistance verification, strap inspection, battery renewal and Klang Valley logistics.
Services are available to private owners resident in Malaysia. Collection and delivery logistics under the Collection Care Retainer are limited to the Klang Valley region.
4. Client Responsibilities
- Ensure that any watch submitted for service is your property or that you have authority to submit it on the owner's behalf.
- Provide accurate information about the watch's known service history and condition when requested.
- Review and sign the Scope Document before work commences. Work will not begin until the signed scope is received.
- Respond to communications regarding scope changes or parts availability within seven working days. Unreasonable delay may affect turnaround timeframes.
- Collect the watch within thirty days of completion notification. Kaliber will make reasonable efforts to contact you. Watches not collected within ninety days of completion may incur storage fees.
- Use the website and communications channels for their stated purpose and not for any unlawful or abusive purpose.
5. Intellectual Property
All content on the Kaliber website — including text, images, service descriptions, methodology descriptions and design elements — is owned by or licensed to Kaliber. You may not reproduce, distribute or use any content for commercial purposes without written permission. Condition reports and service records issued to clients are provided for the client's personal record and may not be redistributed commercially.
6. Payment Terms
Pricing
All prices are quoted in Malaysian Ringgit (MYR) and are inclusive of applicable taxes. The price stated in the Scope Document is the price for the agreed scope. Variations to scope will be priced separately and require written approval before proceeding.
Payment
Payment is due in full on collection of the watch for one-off services. The Collection Care Retainer is billed annually at the start of each programme year. Accepted payment methods are cash, bank transfer and major debit or credit cards.
Cancellation
If you cancel a service after work has commenced, you remain responsible for the cost of work completed to the date of cancellation, including any components already ordered or installed. Parts ordered specifically for your watch that cannot be restocked may be charged in full.
7. Service-Specific Terms
Scope Changes
Where disassembly reveals a condition not apparent before work commenced — for example, a worn component not visible externally — Kaliber will notify you in writing before proceeding with any additional work. No additional costs will be incurred without your written approval.
Parts
Kaliber uses manufacturer-specified or period-correct replacement parts where available. Where exact replacements cannot be sourced, Kaliber will discuss alternatives with you before proceeding. All replaced components are returned to the client with the completed watch.
Workmanship Cover
Full Mechanical Services are covered by a twelve-month workmanship warranty on the labour performed. This covers recurrence of the same fault attributable to the service work and does not cover subsequent damage from misuse, impact, water ingress beyond the tested rating, or normal wear. Vintage Restoration Programme work carries the same twelve-month workmanship cover on the service element.
Turnaround
Stated turnaround times are estimates. Kaliber will notify you if a service is expected to overrun significantly. Delays caused by parts sourcing, specialist external facilities or circumstances beyond Kaliber's control are not considered a breach of these Terms.
8. Disclaimers
Kaliber provides watch servicing with professional care and in accordance with the agreed scope. We do not represent that servicing will restore any watch to factory-new condition or that post-service timing will meet any particular standard beyond reasonable best efforts for the age and condition of the movement.
The website and its content are provided for information purposes and do not constitute professional horological advice specific to your watch or circumstances. You are responsible for decisions made about your watch based on information you receive from us.
9. Limitation of Liability
To the extent permitted by Malaysian law, Kaliber's total liability to you in connection with any service will not exceed the price paid for that specific service. Kaliber is not liable for indirect, consequential or special damages, including loss of use, loss of market value or sentimental loss, arising from service work or any failure to complete work within a stated timeframe.
Nothing in these Terms limits Kaliber's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Malaysian law.
10. Indemnification
You agree to indemnify and hold Kaliber harmless from any claims, losses or expenses arising from: (a) your submission of a watch you did not have authority to submit; (b) inaccurate information provided about the watch's condition or history that affects the service outcome; or (c) your breach of these Terms & Conditions.
11. Termination
Either party may terminate a service engagement before work commences by written notice. Once work has commenced, Section 6 (Payment Terms — Cancellation) applies. Kaliber reserves the right to decline future service engagements from clients who have materially breached these Terms.
12. Dispute Resolution and Governing Law
These Terms are governed by the laws of Malaysia. In the event of a dispute, we encourage direct resolution by contacting us at [email protected]. If informal resolution is not achieved within thirty days, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia, with proceedings in Kuala Lumpur.
Clients may also refer disputes to the Consumer Claims Tribunal of Malaysia for claims within its jurisdictional limits under the Consumer Protection Act 1999.
13. General Provisions
- Entire agreement. These Terms and any Scope Document constitute the entire agreement between the parties and supersede any prior discussions or representations.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
- Waiver. Failure by Kaliber to enforce any provision does not constitute a waiver of that provision.
- Assignment. You may not assign your rights or obligations under these Terms without Kaliber's written consent.
- Notices. Notices under these Terms may be given by email to the address provided at the time of engagement.
14. Changes to These Terms
Kaliber may update these Terms & Conditions from time to time. Changes will be posted on this page with a revised effective date. Continuing to use our services after an update constitutes acceptance of the revised Terms. For active service engagements, the Terms in force at the time of the Scope Document signature apply.
